1. Os titulares de nomes de domínio em Novos Domínios Genéricos de Topo (novos gTLDs) podem receber um “Trademark Claims Notice” ao tentarem registar um nome de domínio.
Como potencial titular de um nome de domínio, poderá visualizar um Trademark Claims Notice ao tentar registar um nome de domínio, caso o nome pretendido corresponda a uma marca registada no TMCH (Trademark Clearinghouse).
Trademark Claims Notice explica que uma empresa ou indivíduo reivindica direitos de marca sobre o termo que está a tentar registar. No entanto, isto não significa necessariamente que não possa registar e utilizar o nome de domínio.
Trademark Claims Notice inclui o nome da entidade que apresenta a (reclamação)claim, a jurisdição em causa, a classe de produtos ou serviços, bem como as informações de contacto da referida entidade.
Após uma análise detalhada do Aviso, você pode decidir prosseguir ou não com o registo do seu nome de domínio.
Caso proceda ao registo do nome de domínio, o titular da marca indicado no Trademark Claims Notice será notificado do seu registo.
Por favor, note que existe uma diferença entre o Claims Notice e a Claims Notification:
Claims Notice:
- Um Claims Notice é apresentado ao titular de um nome de domínio quando este tenta registar um nome de domínio que corresponde a uma marca registada no TMCH (Trademark Clearinghouse).
- Este adviso adverte o titular de que o nome de domínio que pretende registar corresponde a um registo de marca presente na base de dados da Clearinghouse.
- O titular pode ainda assim prosseguir com o registo, mas deve confirmar e reconhecer a receção do aviso.
- O Claims Notice é fornecido pela Base de Dados de Marcas Registadas (TMDB – Trademark Database).
Claims Notification:
- Uma Claims Notification é enviada ao titular da marca caso um nome de domínio correspondente à sua marca seja registado durante o período de reclamações.
- Esta notificação informa o titular da marca de que alguém procedeu ao registo de um nome de domínio que pode eventualmente infringir os seus direitos de marca.
- A Claims Notification é fornecida pela Trademark Clearinghouse (TMCH).

2. Razões pelas quais poderá querer avançar com o registo do seu nome de domínio
O registo do seu nome de domínio pode não infringir os direitos do titular da marca, mesmo que exista uma correspondência total ou parcial entre o nome de domínio e a marca.
Exemplos de nomes de domínio em gTLD que podem não infringir os direitos do titular da marca incluem:
- Limitações geográficas:
Exemplo: Uma marca está registada na República da Coreia (ROK), mas não em nenhum país da América Latina. Se o nome de domínio se destina a ser utilizado na América Latina e não tem como alvo a Coreia do Sul, poderá não infringir os direitos da marca registada nesse país.
- Produtos ou Serviços Diferentes:
Exemplo: Se uma marca está registada para uma determinada categoria de produtos (por exemplo, eletrónica), tal não implica necessariamente que cubra outra categoria distinta (por exemplo, vestuário). Se utilizar o seu nome de domínio para produtos ou serviços diferentes daqueles abrangidos pela marca, poderá não ser considerado uma infração.
- Expressões Genéricas em Marcas Mistas:
Exemplo: No caso de expressões genéricas registadas como marcas mistas (com logótipo), a proteção aplica-se à marca mista no seu todo e não à expressão genérica isoladamente (ou seja, o nome de domínio a registar). Por exemplo, uma marca mista que inclua um termo genérico como “ice cream” num logótipo não impede necessariamente o registo do nome de domínio “icecream.com”, desde que este não utilize o design gráfico do logótipo.
- Utilização Não Comercial:
Exemplo: Um nome de domínio registado para fins pessoais, educativos ou não comerciais, que coincida com uma marca registada para fins comerciais. Se não existir intenção de concorrência comercial, a utilização do nome de domínio pode não ser considerada uma infração. Por exemplo, se quiser registar o meu apelido como nome de domínio para um sítio web dedicado à história da minha família, não deverá haver preferência dada a uma marca que contenha a mesma palavra.
3. Coisas que você deve considerar antes de prosseguir com o registro do seu nome de domínio.
Se o seu nome de domínio corresponder a uma marca registada registada na ICANN Trademark Clearinghouse, o titular da marca registada receberá uma notificação assim que você concluir o registo do seu nome de domínio.
O detentor da marca registada pode então avaliar seu novo registo e uso do nome de domínio, e considerar se ele está infringindo sua marca registada. Se o detentor da marca registada acredita que o nome de domínio foi registado e está sendo usado de má-fé, ele pode tentar transferir o nome de domínio para si mesmo por meio do ICANN's Uniform Domain Name Dispute Resolution Policy, ou tentar suspender o nome de domínio por meio da ICANN Uniform Rapid Suspension (URS) System.
Se o titular da marca registada acreditar que há violação de sua marca registada, ele poderá entrar com outro tipo de ação legal, incluindo um processo judicial na jurisdição de seu registo de marca registada.
