1. I registranti di nomi di dominio nei New Generic Top Level Domains (new gTLDs) possono ricevere un “Trademark Claims Notice” quando cercano di registrare un nome di dominio
In qualità di potenziali registranti, quando cercate di registrare un nome di dominio potreste vedere un Trademark Claims Notice se il vostro nome di dominio corrisponde a un marchio registrato nel TMCH.
Il Trademark Claims Notice spiega che una società o un individuo rivendica i diritti di marchio sul termine che si sta cercando di registrare, ma questo non significa necessariamente che non si possa registrare e utilizzare il nome di dominio. Il Trademark Claims Notice include il nome dell'entità che sta facendo la rivendicazione, la giurisdizione, la classe di prodotti e le informazioni di contatto per l'entità.
Dopo aver esaminato attentamente l'avviso, si può decidere di procedere o meno con la registrazione del nome di dominio.
Se si registra il nome di dominio, il titolare del marchio elencato nel Trademark Claims Notice riceverà una notifica della registrazione del nome di dominio.
Si noti che esiste una differenza tra il Claims Notice e la Claims Notification:
Claims Notice:
- Un Claims Notice viene mostrato al registrante di un nome di dominio quando tenta di registrare un nome di dominio che corrisponde a un marchio registrato nel TMCH.
- L'avviso avverte il registrante che il dominio che sta cercando di registrare corrisponde a un marchio registrato nella Clearinghouse.
- Il registrante può comunque procedere con la registrazione, ma deve confermare l'avviso.
- Il Claims Notice è fornito dal Trademark Database (TMDB).
Claims Notification:
- Una Claims Notification viene inviata al titolare del marchio se un nome di dominio corrispondente al suo marchio viene registrato durante il periodo di reclamo.
- Questa notifica informa il titolare del marchio che qualcuno ha registrato un nome di dominio potenzialmente in violazione.
- La notifica di reclamo è fornita dalla Trademark Clearinghouse (TMCH).
In sostanza, la differenza tra l'Avviso di reclamo e la Notifica di reclamo è il destinatario delle informazioni.
2. Motivi per i quali potreste voler procedere con la registrazione del nome di dominio
La registrazione del nome di dominio non può violare i diritti del titolare del marchio, anche se esiste una corrispondenza totale o parziale con il nome di dominio.
Esempi di nomi di dominio gTLD che non possono violare i diritti del titolare del marchio sono:
- Limitazioni geografiche:
Esempio: Un marchio è registrato nella Repubblica di Corea ma non in nessun paese dell'America Latina. Se il nome di dominio è destinato all'uso in America Latina e non ha come obiettivo la Corea del Sud, non può violare i diritti del marchio in Corea del Sud.
- Prodotti o servizi diversi:
Esempio: Se un marchio è registrato per una specifica categoria di prodotti (ad esempio, elettronica), non è detto che copra una categoria diversa (ad esempio, abbigliamento). Se si utilizza il proprio nome di dominio per prodotti e servizi diversi non coperti dal marchio, non si può considerare una violazione.
- Espressioni generiche in marchi misti:
Esempio: Nel caso di espressioni generiche registrate come marchi in marchi misti (con un logo), la protezione si applica al marchio misto nel suo complesso e non all'espressione (nome di dominio da richiedere) isolatamente. Ad esempio, un marchio misto che include un termine generico come “ice cream” in un logo non impedisce necessariamente la registrazione del nome di dominio “icecream.com” se il nome di dominio non utilizza il design del logo.
- Uso non commerciale:
Esempio: Un nome di dominio registrato per uso personale, educativo o non commerciale che corrisponde a un marchio registrato per scopi commerciali. Se non c'è l'intenzione di fare concorrenza commerciale, l'uso del nome di dominio non può essere considerato una violazione. Se voglio registrare il mio cognome come nome di dominio per un sito web volto a spiegare la storia della mia famiglia, non dovrebbe essere data alcuna preferenza a un marchio che condivide la stessa parola.
3. Cose da considerare prima di procedere con la registrazione del nome di dominio
Se il nome di dominio corrisponde a un marchio registrato nella Trademark Clearinghouse dell'ICANN, il titolare del marchio riceverà una notifica non appena avrete terminato la registrazione del nome di dominio.
Il titolare del marchio potrà quindi valutare la nuova registrazione e l'uso del nome di dominio e valutare se si tratta di una violazione del suo marchio. Se il titolare del marchio ritiene che il nome di dominio sia stato registrato e utilizzato in malafede, può cercare di trasferire il nome di dominio a se stesso tramite l'Uniform Domain Name Dispute Resolution Policydell'ICANN, o cercare di sospendere il nome di dominio tramite l'Uniform Rapid Suspension (URS) System dell'ICANN.
Se il titolare del marchio ritiene che vi sia una violazione del proprio marchio, può intentare un altro tipo di azione legale, compresa una causa nella giurisdizione in cui è stato registrato il marchio.
