Claims Notice:
- Eine Claims Notice wird dem Registranten eines Domänennamens angezeigt, wenn er versucht, einen Domänennamen zu registrieren, der mit einer im TMCH eingetragenen Marke übereinstimmt.
- Es warnt dem Registranten, dass die Domäne, die er zu registrieren versucht, mit einem Markeneintrag im Clearinghouse übereinstimmt.
- Der Registrant kann die Registrierung fortsetzen muss aber die Mitteilung bestätigen.
- Die Claims Notice wird von der Trademark Database (TMDB) bereitgestellt.
Claims Notification:
- Eine Claims Notification wird an den Makeninhaber geschickt, wenn ein Domänenname, der mit seiner Marke übereinstimmt, während der Claims Period registriert wird.
- Diese Benachrichtigung informiert den Markeninhaber darüber, dass jemand einen potenziell verletzenden Domainnamen registriert hat.
- Die Claims Notification wird vom Trademark Clearinghouse (TMCH) bereitgestellt.

2. Gründe für die weitere Registrierung Ihres Domänennamens

- Unterschiedliche Waren oder Dienstleistungen:
Beispiel: Wenn eine Marke für eine bestimmte Warenkategorie (z. B. Elektronik) eingetragen ist, muss sie nicht unbedingt auch für eine andere Kategorie (z. B. Kleidung) gelten. Wenn Sie Ihren Domänennamen für andere Waren und Dienstleistungen verwenden, die nicht durch die Marke abgedeckt sind, kann dies nicht als Verletzung angesehen werden.
- Allgemeine Ausdrücke in gemischten Warenzeichen:
Beispiel: Im Falle von Gattungsbegriffen, die als Marken in gemischten Marken (mit einem Logo) eingetragen sind, gilt der Schutz für die gemischte Marke als Ganzes und nicht für den Ausdruck (den zu beantragenden Domainnamen) für sich allein. Zum Beispiel verhindert eine gemischte Marke, die einen Gattungsbegriff wie „ice ceam“ in einem Logo enthält, nicht unbedingt die Registrierung des Domainnamens „icecream.com“, wenn der Domainname das Logodesign nicht verwendet.
- Nichtkommerzielle Nutzung:
Beispiel: Ein für den persönlichen, schulischen oder nicht-kommerziellen Gebrauch registrierter Domain-Name, der mit einer für kommerzielle Zwecke registrierten Marke übereinstimmt. Wenn kein kommerzieller Wettbewerb beabsichtigt ist, kann die Verwendung des Domänennamens nicht als Verletzung angesehen werden. Wenn ich meinen Nachnamen als Domänennamen für eine Website zur Erläuterung meiner Familiengeschichte registrieren lassen möchte, sollte einer Marke, die dasselbe Wort verwendet, kein Vorzug gegeben werden.
3. Worauf Sie achten sollten, bevor Sie mit der Registrierung Ihres Domänennamens fortfahren
Wenn Ihr Domänenname mit einer im Trademark Clearinghouse der ICANN eingetragenen Marke übereinstimmt, erhält der Markeninhaber eine Benachrichtigung, sobald Sie die Registrierung Ihres Domänennamens abgeschlossen haben.
Der Markeninhaber kann dann Ihre Neuregistrierung und die Verwendung des Domänennamens bewerten und prüfen, ob diese eine Verletzung seiner Marke darstellt.Wenn der Markeninhaber der Meinung ist, dass der Domänenname registriert wurde und bösgläubig verwendet wird, kann er versuchen, den Domänennamen über die Uniform Domain Name Dispute Resolution Policyder ICANN auf sich selbst zu übertragen, oder er kann versuchen, den Domänennamen über das Uniform Rapid Suspension (URS)-System der ICANN zu verbreiten.
